Share this post by email - No Comments - Add A Comment »The Gwinnett County Solicitor’s Office has opened an investigation related to two rezoning applications approved by the Gwinnett County BoC. Both cases involve recent rezoning votes by the BoC associated with solid waste transfer stations and campaign contributions made by the developers who benefited from these BoC votes.
The Gwinnett County planning department, planning commission and Gwinnett Village Community Improvement District had recommended denial for the rezoning requests. A group opposed to one of these projects along with nearby business owners, are currently challenging the board’s decision in Superior Court.
The Gwinnett County Solicitor’s Office is responsible for the prosecution of all State misdemeanor crimes in the State Court of Gwinnett County and all County ordinance violations (including traffic citations) in the Recorder’s Court of Gwinnett County.

Gwinnett Tax Assessments

The article discusses the continuing real estate collapse, the affect on metro Atlanta counties and questions, “Have they gone far enough”.
The following statistics were provided for comparison:
Five major metro Atlanta counties have dropped values for more than 350,000 parcels:
• Clayton: 90,000 parcels, 70,000 parcels lowered (78%)
• DeKalb: 235,000 parcels, 95,000 parcels lowered (40%)
• Fulton: 335,000 parcels, 100,000 parcels lowered (30%)
• Gwinnett: 273,000 parcels, 70,000 parcels lowered (26%)
• Cobb: 246,000 parcels, 20,000 parcels lowered (8%)

Gwinnett Trash, Your Money & The Beaudreau Vote
Share this post by email - No Comments - Add A Comment »The purpose of this post is to highlight the voting record of your commissioner, Mike Beaudreau as it applies to recent rezoning applications for garbage transfer stations. Even though none of these proposed transfer stations are in our immediate community, it is important to understand how your elected commissioner conducts himself in the face of what is probably intense political pressure coming from within the Gwinnett Board of Commissioners.
The crux of the matter is the appropriate location for a waste transfer station. How Gwinnett County planners and waste professionals recommend one location and how the BoC subsequently rejects these recommendations - by vote - and substitute their own.
It’s about how the BoC’s ultimate decision for location is influenced by political contributions paid to them by the developers who own the land… and the lack of public disclosure of these contributions.

Three Redevelopment Districts Proposed

The Gwinnett County Redevelopment Agency on Wednesday recommended creation of three new tax allocation districts.
The County Commission now must approve or deny the proposals - and that is expected to come in December. The Gwinnett County School Board would also need to sign on if it were to participate in the effort.
Voters on Tuesday apparently approved a constitutional amendment allowing school districts to once again participate in tax allocation districts. The Georgia Supreme Court ruled in February that the state constitution forbade the use of education funds in TADs. Tax allocation districts produce money to pay for redevelopment by diverting revenues from rising property values into a special fund to pay for construction costs.
Gwinnett’s districts would be located along U.S. 78 between Stone Mountain and Snellville, in Norcross along Jimmy Carter Boulevard and in Duluth between Gwinnett Place Mall and I-85.
The funding tools are widely regarding among county officials and the business community as the best way to foster redevelopment in the southern part of the county, which developed between the 1970s and 1980s and is suffering from high vacancies, under-utilized properties and traffic problems.
The Gwinnett Place TAD would feature $2 billion in development spread across four clusters around Gwinnett Place Mall. The Gwinnett Village district envisions two major projects, one at Jimmy Carter Boulevard and I-85, and the other at Indian Trail Boulevard and I-85. And the U.S. 78 district would include three major centers in a district that spans the distance between Stone Mountain and Snellville.

The department has recommended approval with conditions. The applicant is Rockbridge Self Storage LLC., Lawrenceville and the owner is Noorallah Alimohammed, Stone Mountain. The planning commission action was to deny.
SUP-08-076 - Tabled until Nov. 18: A requested special-use permit in a general-business district to allow for a used automobile sales lot and accessory service center on 4.11 acres. The property is located at the 4300 block of Stone Mountain Highway. The department has recommended approval with conditions. The applicant is Navid Yazdanpanah, Buford and the owner is Karen Maclaurin, Buford. The planning commission tabled this case until its Nov. 5 meeting.
SUP-08-081 - Denied without prejudice: A requested special-use permit in a single-family residence district to allow for a 31,374-square-foot day care facility as an accessory use to an existing church on 11.38 acres. The property is located at the 600 block of Rockbridge Road just outside the city of Lilburn. The department has recommended approval with conditions. The applicant is New Mercies Christian Church, Lilburn, and the owner is Jesse Curney III, Lilburn. The planning commission action was to deny without prejudice.

The recommending body only took action on three cases.
RZC-07-041 Heard by order of the court after the applicant’s constitutional rights had been violated the year before, the commission approved a rezoning from a single-family residence to an office and institutional district for a property located in the 2100 block of Rockbridge Road. This same request was denied by the Board of Commissioners in 2007.
The board also approved with conditions an automotive car wash and oil change facility being conceptualized by Meridian Development to be located at the 500 block of U.S. Highway 78 and the 3200 block of Krisam Creek Drive east of Snellville. One of the conditions set for this development included the prohibition of self-service vacuums and a stipulation that the facility must meet the overlay standards for the Highway 78 district.
These cases will now move to the Board of Commissioners agenda to be heard at its Tuesday monthly meeting to consider zoning requests.
