Walton EMC’s Tru Check Meter Reader Incident
Share this post by email - No Comments - Add A Comment »A couple of neighbors contacted me regarding an incident involving a Tru Check meter reader crew and the Gwinnett County Police last Friday, January 23, 2009. I contacted Walton EMC regarding the incident and the following is their response:
Last Friday a customer saw two people going through his back yard and did not know who they were so he called Gwinnett County Police to check it out. After arriving they found that it was Walton EMC’s meter reading contractor Tru-check. The officers talked with the readers and checked them out for identification to be sure that they were legitimate. There were two readers. One was a reader and the other was a meter reader trainee. After everything was checked out and verified everyone went on there way.

CHHA Continues To Evade Requests
Share this post by email - 1 Comment - View And/Or Add A Comment »The CORINTH HILLS HOMEOWNERS ASSOCIATION, INC. (CHHA) sent me a USPS Certified letter that I signed for today (11/20/08). I’m actually very glad that they did. In it, among other things, they attempt to dictate to me how I am to run this (my) website. They apparently are not pleased with criticism. They also attempt to tell me how I should interpret the Georgia Code as it applies to TITLE 14. CORPORATIONS, PARTNERSHIPS, AND ASSOCIATIONS, CHAPTER 3. NONPROFIT CORPORATIONS.
The president of the CHHA states in her letter to me that I haven’t properly requested information from the corporation. She also states that requests via e-mail are not proper. Here is my latest request (my first valid request was made 10/23/08 - almost a month ago):

CHHA Board -
I would again, via electronic transmission - this e-mail, like to request copies of the CHHA financial records. I owe you no explanation as to why I wish to review these records.
Georgia Code - Corporations and Partnerships - Title 14, Section 14-3-1620
(a) A corporation upon request in writing or by electronic transmission from a member shall furnish that member its latest prepared annual financial statements, which may be consolidated or combined statements of the corporation and one or more of its subsidiaries or affiliates, in reasonable detail as appropriate, that include a balance sheet as of the end of the fiscal year and statement of operations for that year. If financial statements are prepared for the corporation on the basis of generally accepted accounting principles, the annual financial statements must also be prepared on that basis.
(b) If annual financial statements are reported upon by a public accountant, the accountant´s report must accompany them. If not, the statements must be accompanied by the statement of the president or the person responsible for the corporations financial accounting records:
(1) Stating the president´s or other persons reasonable belief as to whether the statements were prepared on the basis of generally accepted accounting principles and, if not, describing the basis of preparation; and
(2) Describing any respects in which the statements were not prepared on a basis of accounting consistent with the statements prepared for the preceding year.

I invite the CHHA board, our association membership and any interested attorneys to review these requests, contact the Georgia Secretary of State and ask questions.
Then ask yourselves,… what’s the big deal? Why won’t the CHHA comply? Why has the CHHA stated in writing and verbally via phone (of which I have a voice mail) that they will comply, but yet they haven’t? Why is that? Why? It’s the law that the CHHA agreed to comply with when they incorporated as a public entity. Why? Why is it that they won’t comply? I don’t understand,… I’ve abided by the Georgia Code with respects to my requests,… I have given them much longer to comply than what the Georgia Code dictates (5 days), yet I still have not received the financials that I have requested? Why?

Our Recent Exposure To Arts & Culture…
Share this post by email - 3 Comments - View And/Or Add A Comment »…Okay, maybe it’s just gang graffiti. This is a post I feel compelled to write - which I don’t like to do - just due to the number of e-mails I’ve received today and the unusually high number of visitors the website has received. This all being said, I really don’t have a whole lot to allow. Hopefully a few visitors will make replies.
I took digital photos of all of our new artwork and sent a few to Major Keybo Taylor, our GCPD precinct commander. His response was, “I will pass this on to Sgt. Cavender with the Gang Unit. We will contact someone to clean the streets up. Thank you for taking the time to bring this to our attention.” I had asked some very specific questions that went unanswered.
I then went to the Gwinnett County website and poked around but found very little specific to gang activity. I also Googled for awhile and came up with the following (albeit not a lot):
• From 11Alive:
Updated 3/7/2008 8:44:01 AM
Written by: Julie Wolfe
Gwinnett County’s new gang task force hits the streets this weekend. Twenty-five to thirty-five officers will be part of the county’s new enforcement strategy. The extra officers will be absorbed from the current gang task force and community response teams.
Corporal Illana Spellman says the move is not in response to a growing gang problem in Gwinnett County: ‘There was no specific incident, and no statistics to support gang activity on the increase,’ she said. ‘This is a new approach to an old problem.’
That new approach will include stepped up police presence in problem areas. The task force will also conduct investigations, gather evidence, and make arrests. It’s the county’s most comprehensive crackdown on gang activity in years.
Residents that spot signs of gang activity, like graffiti, are asked to call Gwinnett County police.
• Gwinnett County Police Crime Suppression Unit
The Crime Suppression Unit is primarily responsible for providing support to the different precincts in their effort to combat criminal activity. When patterns of criminal activity are identified, these officers respond in force in a concentrated effort to identify and apprehend offenders. These officers are also responsible for the Department’s efforts to combat gang related criminal activity.

August 24th, 2008 at 1:57 PMF.Y.I. — The county came out and used black spray to cover the graffiti on the sidewalk in the 1700 block of Pounds Road at the intersection of Corinth Circle. A few days later a new batch of graffiti appeared in the same spot but this time white spray paint was used on the black cover. I used the online form on the Gwinnett Clean & Beautiful website to report it and the new graffiti spot was recovered by the county in white which actually looks better on the sidewalk.

Graduation Banners
Share this post by email - 2 Comments - View And/Or Add A Comment »Changes to the temporary signs section of the Gwinnett County Sign Ordinance were approved by the Gwinnett County Board of Commissioners on March 25, 2008. These changes include adding a section to allow for graduation banners.
Graduation banners may be placed on residentially zoned property. Such banners may be no more than 24 square feet in size and must be maintained in good condition and individually attached to a pole, mast, arm, or other structure. A graduation banner may not be displayed on any lot for more than 60 consecutive days.

May 7th, 2008 at 4:18 PMYou must be kidding. With Gwinnett’s problems with traffic, illegal immigration, budget, and other issues, they took the time to worry about including graduation banners in a law. Personally, I think graduation banners are tacky and even cheesy (referring to the ones that go on the entrance of subdivisions), but I realize that at that point in your life, kids think that graduating from high school is the most significant thing in life. However, even if they are tacky, do we need a law addressing them? So we need Gwinnett cops and code enforcers wasting time trying to figure out if a banner has been up for 59 days or 61? Just another example of the out of control influence of government in the most menial things in our lives. When are we as citizens going to say enough and tell government to back off?

CorinthHills.org Says:
May 12th, 2008 at 2:16 PMBy MICHAEL PEARSON
The Atlanta Journal-Constitution
Published on: 03/24/08Turns out those celebratory graduation banners that pop up every spring in front of Gwinnett County subdivisions have one teensy, weensy little problem.
Technically, they’re illegal.
Just in time for graduation season, the County Commission is set to address that problem Tuesday with an ordinance that would put proud parents back on the right side of the law. The ordinance would also spare code enforcement officers the awkward task of having to pull down signs blaring such happy news.
“It was a big issue because you had parents who wanted to show pride in their kids and they’re weren’t able to,” said County Commissioner Mike Beaudreau.
The issue caused a ruckus last spring, with rumors of a ban on the signs leading to complaints to the county and eventually an informal suspension of the rules on graduation banners.
Kathy Holland, director of the county planning department’s development division, said parents have always been allowed to post a sign of up to 16 square feet in their own yards celebrating a graduation.
But nothing in the county’s sign ordinance authorizes the display of graduation banners typically found at the entrance to subdivisions, she said.
“What was happening is they were being removed through the typical sign sweeps,” she said.
If approved, the new rules will allow banners of up to 16 square feet for up to 60 days, so long as they’re kept in good repair and don’t encroach on the right of way.
At that size, some neighborhoods could still get into hot water.
While individual signs are by far the most popular, most neighborhood groups go for signs of 15 to 32 square feet, said Nicole Mewhiney, account manager at FastSigns in Norcross.
Jill Stoneberg, a resident of Flowers Crossing at the Mill in Lawrenceville, said her neighborhood association would likely ask that the county increase the size of the banners to make sure her 600-home subdivision can get all of its kids properly listed.
“The smaller the banner, the smaller the fonts,” she said. “It’s hard to read.”
Holland said she realized some groups may not be happy with the size restriction, but said her office tried to remain consistent with what was already contained in the law regarding such signs.
“It’s something we didn’t want to discourage but felt we needed to have some control,” she said.

Subject: A Strange Break-in
I came home this morning at 11:45 am, after being away for 3 hours and
45 minutes, to find that someone had come into my house, taken food out of
the refrigerator and ate it, and left dirty dishes in the sink. They
took a never-used kitchen knife out of a drawer, threw away the cardboard
sheath it came in, slashed open a new package of shredded mozzarella
cheese and enjoyed ( I assume) some of the cheese with about 4 cups of
ground chuck spaghetti sauce I had made. There was no sign of forced
entry, and nothing else was touched (jewelry, medications, etc.). I did
file a police report, though it was a bit embarrassing to do so. It is
one of those stories that seem funny when they happen to someone else,
but it is spooky when it is your house and your food. Of course, I
threw away the rest of the package of cheese. I had just bought lots of
groceries, and now I feel nervous about all of the other food in the
refrigerator.

Thanks for sharing your incident. Would you mind if I post your message on
the website? It might help others and perhaps yourself.
A few questions:
- Were your doors and windows locked?
- Do you have an alarm system?
- Has anything like this happened to any of your neighbors?
- What did the police have to say?
- Whereabouts on Pounds are you?
Thanks again -

Marty,
Alerting others is my main reason for emailing the organization. My
windows and doors were locked. No scratches on carport door knob lock.
It must have been easy. I can’t afford an alarm system (I’m unemployed).
The police officer said, “So, they took spaghetti sauce and cheese, but
no noodles?” I asked whether it would be a more serious crime if they
took noodles. How can it really be considered seriously? It is a very
strange crime, with nothing taken except food. The officer said that he
would write a report. As I’m sure you know, Pounds Road is a busy
through street, and folks don’t share much. I have renters on one side
of me and a vacant house on the other. I have been in contact with
neighbors across the street. My carport faces the street, so anyone
could see when my car was gone. I don’t know of any other similar
incidents. Besides being spooked by the fact that someone was in my
house, I was furious when I had to wash the burglar’s dirty dishes! I
thought I gave my address on Pounds in my email. 1678 - third house from
blinking red four way stop at Corinth Cir.
Thanks.

A jewelry store owner and his wife were forced from their home at gunpoint Wednesday, Dec. 26 and their 15-year-old son was held hostage.
Reported By: Charles Molineaux
GWINNETT COUNTY, Ga. (FOX 5) - A jewelry store owner and his wife were forced from their home at gunpoint Wednesday and their 15-year-old son was held hostage.
Homeowner Sam Mahabal walked gingerly out of his Stone Mountain home Wednesday evening, favoring ribs he said were broken while fighting with a crew of three armed robbers.
Mahabal said the gunmen descended on his home, crudely disguised as police.
“They had on them reflective vests that basically said ‘Police’ on them. The homeowner, thinking they were actual police, opened the door,” said James Polite of the Atlanta Police Department.
Mahabal said he tried to fight back, but the men beat him, fired a shot at him and ransacked his home. Mahabal said the suspects tore out security cameras that were installed after he was robbed at his home last year.
The gunmen then held Mahabal’s 15-year-old son at gunpoint in the basement while Mahabal and his wife were forced into the family’s Hummer SUV.
“They held the son hostage until they could feel secure that they finished the robbery,” said David Schiralli of the Gwinnett County Police Department.
Atlanta police said the suspects then forced the victims to go the family’s jewelry store and made them unlock the door and it was then that Mahabal took an opportunity to escape.
“Fortunately at that particular time, he managed to escape and at that time the suspects became fearful and let in the victims’ vehicle,” said Polite.
The Hummer was later abandoned a few blocks away.
The man who installed the security system for Mahabal’s store said there has never been a hold-up at the store, but the gunmen may have followed the victims’ home.
Investigators warned people to beware of people claiming to be police, even if they are wearing vests that say they are.
“We should be in uniform. If not, there will be a picture ID. Also, we will have a marked patrol vehicle,” said Polite.

For non-compliance issues see Section 14-3-1604. These issues go before a Superior Court judge so you can start by going to the gsccca.org website for more information or you can call the Superior Court Clerk’s Office at 770-822-8100 and speak with someone there about how to proceed. There is a fee to file, but a judge will order the association to pay that fee and for associated attorney fees if it finds in your favor.
I’ve sent you an email too.
