Gwinnett BoC Trash Talk

Share this post by email - 2 Comments - View And/Or Add A Comment »

The Gwinnett County Board of Commissioners are set to discuss two lawsuits pending over county mandated trash service. Tuesday’s (November 17, 2009) special meeting is to be held with the garbage vendors who are suing the county along with mediators who will attempt to resolve the two pending 40 million dollar plus lawsuits. Yes, $80,000,000.00+.

Guess who pays the settlement? Guess how. These are the same commissioners who suggest that Gwinnettians give up one movie a month so that we can pay higher taxes.

Wasn’t the county mandated garbage service supposed to save us money? It appears to me that not only will I not save on my garbage service, but now my taxes will be raised to pay for the lawsuits. Am I missing something?

USGS Defines September Floods As Epic

Share this post by email - No Comments - Add A Comment »

The U.S. Geological Survey has stated that the flooding experienced in north Georgia was “extremely rare, epic, stunning and off the charts”. Statistically it was the type of flood that is only projected to be experienced once every 500 years.

Average annual rainfall for metro Atlanta is around 50 inches. Many locations received rainfall totals approaching the 20 inch mark during the 24 hour period of September 20th through September 21st. That equates to 40% of an average annual rainfall in one day.

Scientists are describing the September flooding as one of the worst flood events experienced in the U.S. in the last 100 years.

There was an armed robbery at the Walmart on Rockbridge Road. It happened at 2140 hrs (9:40 PM) on 05/11/09. Three suspects entered the Walmart and approached the service desk. They asked a clerk if they sold lottery tickets. Before the clerk could answer, they pointed a handgun at the clerk and demanded money. One suspect ran behind the counter and grabbed a bag of money. All three suspects fled on foot. Nobody was injured.

Walton EMC’s Tru Check Meter Reader Incident

Share this post by email - No Comments - Add A Comment »

A couple of neighbors contacted me regarding an incident involving a Tru Check meter reader crew and the Gwinnett County Police last Friday, January 23, 2009. I contacted Walton EMC regarding the incident and the following is their response:

Last Friday a customer saw two people going through his back yard and did not know who they were so he called Gwinnett County Police to check it out. After arriving they found that it was Walton EMC’s meter reading contractor Tru-check. The officers talked with the readers and checked them out for identification to be sure that they were legitimate. There were two readers. One was a reader and the other was a meter reader trainee. After everything was checked out and verified everyone went on there way.

CHHA Continues To Evade Requests

Share this post by email - 1 Comment - View And/Or Add A Comment »

The CORINTH HILLS HOMEOWNERS ASSOCIATION, INC. (CHHA) sent me a USPS Certified letter that I signed for today (11/20/08). I’m actually very glad that they did. In it, among other things, they attempt to dictate to me how I am to run this (my) website. They apparently are not pleased with criticism. They also attempt to tell me how I should interpret the Georgia Code as it applies to TITLE 14. CORPORATIONS, PARTNERSHIPS, AND ASSOCIATIONS, CHAPTER 3. NONPROFIT CORPORATIONS.

The president of the CHHA states in her letter to me that I haven’t properly requested information from the corporation. She also states that requests via e-mail are not proper. Here is my latest request (my first valid request was made 10/23/08 - almost a month ago):

CHHA Board -

I would again, via electronic transmission - this e-mail, like to request copies of the CHHA financial records. I owe you no explanation as to why I wish to review these records.

Georgia Code - Corporations and Partnerships - Title 14, Section 14-3-1620

(a) A corporation upon request in writing or by electronic transmission from a member shall furnish that member its latest prepared annual financial statements, which may be consolidated or combined statements of the corporation and one or more of its subsidiaries or affiliates, in reasonable detail as appropriate, that include a balance sheet as of the end of the fiscal year and statement of operations for that year. If financial statements are prepared for the corporation on the basis of generally accepted accounting principles, the annual financial statements must also be prepared on that basis.

(b) If annual financial statements are reported upon by a public accountant, the accountant´s report must accompany them. If not, the statements must be accompanied by the statement of the president or the person responsible for the corporations financial accounting records:

(1) Stating the president´s or other persons reasonable belief as to whether the statements were prepared on the basis of generally accepted accounting principles and, if not, describing the basis of preparation; and

(2) Describing any respects in which the statements were not prepared on a basis of accounting consistent with the statements prepared for the preceding year.

CHHA Board -

My apologies, I cited the business chapter and not the nonprofit chapter…
TITLE 14. CORPORATIONS, PARTNERSHIPS, AND ASSOCIATIONS, CHAPTER 3. NONPROFIT CORPORATIONS

If financial statements are prepared for the corporation on the basis of generally accepted accounting principles, the annual financial statements must also be prepared on that basis.

In the near future I will be making additional requests pursuant to:
Title 14, Section 14-3-1602 Member rights to information.
Title 14, Section 14-3-720 Member rights to member list.

Just FYI:
Title 14, Section 14-3-1604 Corporation non compliance of member requests.

Again, I apologize for any confusion.

Here’s a link to the specific article: http://law.onecle.com/georgia/14/14-3-1620.html

Here’s a link to the Georgia Secretary of State: http://www.sos.georgia.gov/

I invite the CHHA board, our association membership and any interested attorneys to review these requests, contact the Georgia Secretary of State and ask questions.

Then ask yourselves,… what’s the big deal? Why won’t the CHHA comply? Why has the CHHA stated in writing and verbally via phone (of which I have a voice mail) that they will comply, but yet they haven’t? Why is that? Why? It’s the law that the CHHA agreed to comply with when they incorporated as a public entity. Why? Why is it that they won’t comply? I don’t understand,… I’ve abided by the Georgia Code with respects to my requests,… I have given them much longer to comply than what the Georgia Code dictates (5 days), yet I still have not received the financials that I have requested? Why?

I just spoke with Frances Smith (CHHA President) by phone (770-403-7025) on Friday, October 24, 2008 at approximately 7:45 PM. I was told by Ms. Smith (and also have a voice mail from her stating the same thing) that she would no longer respond to emails from me. I requested that she provide me with the name and phone number of the attorney who advised her of this and she refused to provide this information.

I also included the CHHA 1st vice president and the CHHA secretary in each e-mail message - neither of whom ever bothered to reply.

No further contact. ¦Hmmmm¦ Nothing to hide¦

One Response To “CHHA Continues To Evade Requests”

  1. fwy545 Says:

For non-compliance issues see Section 14-3-1604. These issues go before a Superior Court judge so you can start by going to the gsccca.org website for more information or you can call the Superior Court Clerk’s Office at 770-822-8100 and speak with someone there about how to proceed. There is a fee to file, but a judge will order the association to pay that fee and for associated attorney fees if it finds in your favor.

I’ve sent you an email too.

Our Recent Exposure To Arts & Culture…

Share this post by email - 3 Comments - View And/Or Add A Comment »

…Okay, maybe it’s just gang graffiti. This is a post I feel compelled to write - which I don’t like to do - just due to the number of e-mails I’ve received today and the unusually high number of visitors the website has received. This all being said, I really don’t have a whole lot to allow. Hopefully a few visitors will make replies.

I took digital photos of all of our new artwork and sent a few to Major Keybo Taylor, our GCPD precinct commander. His response was, “I will pass this on to Sgt. Cavender with the Gang Unit. We will contact someone to clean the streets up. Thank you for taking the time to bring this to our attention.” I had asked some very specific questions that went unanswered.

I then went to the Gwinnett County website and poked around but found very little specific to gang activity. I also Googled for awhile and came up with the following (albeit not a lot):

• From 11Alive:
Updated 3/7/2008 8:44:01 AM

Written by: Julie Wolfe

Gwinnett County’s new gang task force hits the streets this weekend. Twenty-five to thirty-five officers will be part of the county’s new enforcement strategy. The extra officers will be absorbed from the current gang task force and community response teams.

Corporal Illana Spellman says the move is not in response to a growing gang problem in Gwinnett County: ‘There was no specific incident, and no statistics to support gang activity on the increase,’ she said. ‘This is a new approach to an old problem.’

That new approach will include stepped up police presence in problem areas. The task force will also conduct investigations, gather evidence, and make arrests. It’s the county’s most comprehensive crackdown on gang activity in years.

Residents that spot signs of gang activity, like graffiti, are asked to call Gwinnett County police.

Gwinnett County Police Crime Suppression Unit

The Crime Suppression Unit is primarily responsible for providing support to the different precincts in their effort to combat criminal activity. When patterns of criminal activity are identified, these officers respond in force in a concentrated effort to identify and apprehend offenders. These officers are also responsible for the Department’s efforts to combat gang related criminal activity.

The DOT came by today and covered over our artwork.

I noticed one spot of graffiti on the Pounds Rd. sidewalk (near Corinth Cir.) which did not get cleaned up.

If you spot or hear of other areas that were marked up please submit details so that we can track.

  3. j.q.public Says:

F.Y.I. — The county came out and used black spray to cover the graffiti on the sidewalk in the 1700 block of Pounds Road at the intersection of Corinth Circle. A few days later a new batch of graffiti appeared in the same spot but this time white spray paint was used on the black cover. I used the online form on the Gwinnett Clean & Beautiful website to report it and the new graffiti spot was recovered by the county in white which actually looks better on the sidewalk.
